Can a handyman replace a toilet in Maryland?

Setting a toilet is plumbing work under Maryland law, because a toilet is a plumbing fixture and the shutoff and supply line are piping. The licensed plumber on our bench does the swap. A handyman with an MHIC license handles the floor repair, the caulk and a seat swap, and we quote the two together.

What Maryland law says

Maryland requires a Maryland Home Improvement Commission (MHIC) contractor license for anyone who performs, or offers to perform, home improvement work for a homeowner (Business Regulation Article, section 8-301(a)). Repair and replacement of part of a house counts as home improvement under section 8-101(g), and the statute sets no dollar minimum. A handyman who charges for the work needs the license.

Water lines and fixtures are a separate trade. Under the Business Occupations and Professions Article, section 12-101(n), plumbing services means to install, maintain, extend, alter or remove piping, a plumbing fixture or a plumbing appliance. That work belongs to a licensed master plumber or someone working under one. Baltimore County and the WSSC parts of Montgomery and Prince George’s run their own plumbing boards under section 12-103.

How we handle it

The usual call is a toilet that rocks, runs, or came with the house in 1988. The plumber pulls the old one, checks the flange, sets a new wax ring or a waxless seal, and swaps the shutoff when it is the old multi turn kind that never fully closes. A cracked flange or a soft subfloor turns it into a repair job, and that is where the handyman comes in.

In the District and Northern Virginia the plumbing license rules are different, and we use a plumber licensed there. The estimate names the license either way.

On our side this falls under fixture and appliance installs, and the price range is on the toilet installation cost in maryland page.

Questions we get about this job

Can I replace my own toilet in Maryland?
A homeowner working on the house they live in is generally allowed to. The license rule is about people who do it for pay.
Does a toilet swap need a permit?
A like for like replacement usually does not. Moving a drain or adding a bathroom does. Baltimore County and the WSSC area have their own plumbing offices, and the plumber checks with the right one.
Can the handyman fix the floor under the toilet?
Yes. Rotted subfloor, a loose flange ring and the caulk line are repair work. The plumber resets the toilet after the floor is fixed, same visit when the rot is small.
